Unfortunately my experience with Raquel Quenneville was not good. A bit of background. I was a landlord and one of my tenants passed away at the hospital in December 2020. It turned out the tenant was a hoarder and it cost me just over $13,400 to do the clean up and repairs. On 28 October 2021 I hired Ms. Quenneville to bring the matter to Small Claims Court as we were suing the deceased tenant’s estate for the costs to repair the apartment. Things went well except we were getting closer and closer to 16 March 2022, which was our 2 year dead line to file court papers in Small Claims Court. Emails and voice mails sent to Ms. Quenneville were often unanswered. I pushed harder and she got the court papers filed literally on the dead line. (Because of Covid the government had extended the 2 year dead line by 6 months but this matter was not complicated, we shouldn’t have to count on the extension for something that should have already been before the court)
I was not happy with the delay but at least things were moving. We went to a settlement conference on 09 January 2023. The executor of the estate was given 30 days to produce papers or the matter would ultimately proceed to trial and from what the Judge said would likely result in a Judgement against the executor for the $13,000 plus in damages.
The 30 day limit passed on 09 February 2023. Starting in March 2023 I started emailing Ms. Quenneville asking for updates because I really wanted to get this matter over with. No response. I emailed again in April and May. I also left voice messages between March and November 2023 asking for updates and stating this matter needs to be dealt with. No response, it got so bad my wife actually went to Sudbury twice to knock on Ms. Quenneville’s office door to ask what the hold up was. Ms. Quenneville was not there either time.
Finally in August and again in October 2023 Ms. Quenneville sent an email to the executor asking the executor to comply with producing the records that should have been produced before 09 February 2023. I was sending “what the heck is taking so long” emails and voice messages to Ms. Quenneville. Rarely a response. (I was never nasty but I was persistent because I was tired of it and wanted this matter finally dealt with)
On 14 November 2023 the executor died…..
Ms. Quenneville advised the situation is now to complicated because it involves two estates so I have to hire an estate lawyer. (I did call several lawyers, no one wants to touch it, its to messed up now)
Here’s the thing, if this matter had been brought to the court in a reasonable time it would have almost certainly resulted in a Judgement against the executor. Then, when the executor passed away, the executor’s estate would have had to pay the judgement, it wouldn’t have been complicated at all.
Ms. Quenneville appears competent, knowledgeable and friendly but the delays, lack of action and not responding to my questions on this file has cost me the $13,000 plus in damages. While a person may rightfully argue that we can’t account for something like the executor passing, the reality remains that between 09 February 2023 and 14 November 2023 virtually nothing was done to bring this matter to court. After 14 November, well, it was to late.
