All litigators abide to the rule time is money, hence least amount of effort (time) for a reasonable return whereby return is money and for those that are any good, reputation/self pride. If you are heading to court you need a representative who is already case competent by experience or even better one who refuses to loose and knows most win by out lawing their opposition by actually fulfilling their duty to court which in lay terms is spoon feeding the judge (legislation, equity/case law ratio) while elegantly showing the judge the opposition has not. I once retained Mr. Brown to do this and after he gobbled up the initial retainer I was grateful to perceive his concept of the rule was like that of a cab driver that takes you unnecessarily into construction, lots of noise and going no where fast while the meter ticks on. As for case competence he never even came close to which I recall him having a laugh over my outcome expectations which I did fully achieve, to which I am certain he was not up to the task as I recall him saying “I think the judge liked me because I was asked for further submissions on a specific issue”, which of course was not an expression of feelings but rather an obvious desire not to punish his client for want of relevant arguments that should have been made. In fairness the effort I made to win, besides his errors while suffering him, could only have been expected of one who was not simply making a living and could realize the action was an opportunity to become an expert in a specific field with proof of case competence and ability published in CanLII. Yes litigators are like mechanics in that they should be able to work on anything, but why pay for an unsupervised apprentice that watches the clock and has limited ambitions.
